Three separate tender processes are opening in the coming weeks for the award of contracts to deliver:
  • Civil Legal Advice (CLA) specialist telephone advice in the discrimination and/or education categories from 1 April 2021
  • Criminal Defence Direct (CDD) services from 1 June 2021
  • Immigration Telephone Advice (ITA) services from 1 June 2021
The tender process for CLA education and discrimination contracts is expected to open before the end of September. Tender processes for CDD and ITA contracts will follow in October.

    LAA 19 Covid-19 Questions
    T
he Law Society confirmed with David Thomas, the LAA’s Head of Contract Management and Assurance, that responding to the 19
    Covid-19 questions is ‘optional’. The LAA did not make this clear at the time of publishing the 19 Covid-19 questions to providers.
    Subsequent pressure on the LAA with how onerous the task was brought about a change of heart.

    In any event, it is always best for providers to maintain a healthy relationship with their LAA Contract Manager. Responding to all the
    questions in writing with supporting documentation would be a very time consuming and costly option. The best option of
​    response is to telephone your CM and provide general feedback to them over the phone, as they will only really be concerned
    with the financial details if they detect there are underlying financial difficulties which may present a risk to the legal aid fund.
    Several of our clients have done this and had fairly brief telephone calls for which the CM was grateful.

    Contractually, under the Standard Civil Contract 2018 Standard Terms, you are obliged to:

You must disclose your annual accounts to us in accordance with any Relevant Professional Body rules when requested pursuant to Clause 9.1. 
4.4 In addition and without limiting Clause 9.1, if: 
(a) you are under Official Investigation; 
(b) you have exceeded your Maximum PoA Limit; 
(c) your accounts are not audited and/or certified by an independent accountant or the independent auditor qualifies your accounts; 
(d) your financial position is such that we consider that there is a significant risk to your Clients or public funds; or 
(e) we have any reasonable concerns about your financial position, you must within 14 days of our request disclose to us such other financial information as we reasonably require about you (including information about your monthly management accounts, Bank Covenants, Bank Facilities and your and your partners’ and/or directors’ loan agreements and details of other assets and liabilities) and/or about Contract Work (and any other work secured by us).

9. Provision of information and access to your premises

We may from time to time require you to provide us with Records in connection with the performance of your obligations under this Contract, including during any Audit. You will provide us with the same promptly and in any event within ten Business Days or such other time period as we may reasonably specify. If any such Records are held by a third party you must promptly, upon receipt of our request, arrange for such Records to be sent to us.

New guidance available on GOV.UK explains the legal requirement to only send encrypted removable media in support of     
    applications and bills. Providers should avoid submitting removable media in an unencrypted state. If the LAA receive unencrypted
    items, they will still process the information contained on the removable media, but they are not able to take the risk of data loss by
    returning unencrypted media either through the post or by DX. The LAA will destroy items after 28 days.
 They are currently testing 
    two suppliers to trial alternatives to sharing data by removable media and reliance on sending USBs and CDs.
